The BZA members voted unanimously to grant the variance with the condition that construction be limited to the carport. Neighboring landowner Levi Atkins had registered the only objection to Mr. Whorton’s request. In a letter to the BZA, Mr. Atkins asked that the variance be denied since Mr. Whorton’s house already violated setback regulations. He also expressed concern that the carport would be turned into living space.

“That’s not a legitimate concern,” said Mr. McCarthy. Before the carport could be remodeled, Mr. Whorton would have to obtain a building permit and another variance, the zoning administrator noted.

Decision deferred

Anticipating a less than unanimous endorsement for his variance request, Languin Barron acceded to a suggestion for postponement until the BZA’s next meeting when all five members are expected to be present.

“There are only three of us here. If one of us can’t make the findings (necessary for granting a variance), you’re shot down,” Mr. Monahan noted. “I’m not telling you how I’m going to vote, but it may be in your best interests to defer a decision.”

“I guess I’ll be back here September 24,” Mr. Barron replied. “I’m glad we didn’t plan to build this addition until next spring!”

Mr. Barron is seeking a setback variance for an addition to his earth berm solar residence on Route 645 near Rappahannock Lakes. The house is built into a hillside and sited 15 degrees of due south on the highest part of the 5.88 acre lot to achieve maximum efficiency from solar collectors. The structure now meets the 50 foot sideyard setback distance but the addition would be within 30 feet of the adjoining property line.
