After Monday’s hearing, they have 10 days to submit a recommendation to the Department of Waste Management. However, as Zoning Administrator John McCarthy pointed out, the department is not bound to act on the landfill application in accord with the board’s recommendation. “The Supervisors’ recommendation will have little or no bearing on what the state’s action will be,” he told the landfill opponents at Monday’s hearing. Whether the state grants Mr. List a permit for a landfill will depend primarily on geological and hydrological conditions at the site, he said.
But even with a permit from the state, a landfill at the quarry site could not begin operations without an amendment to the county’s zoning ordinance, he said. The quarry site is zoned industrial; a sanitary landfill is not listed as an allowed use in that zoning category and uses not listed are specifically prohibited, Mr. McCarthy noted.
