When Rappahannock’s new zoning ordinance is adopted in December — as intended by the Board of Supervisors - it will be without a provision for migrant worker housing as an accessory use allowed by right.
Until last Wednesday night’s work session, the final for the proposed ordinance, a farmer or orchardist would have been permitted a migrant camp on agriculturally zoned land for five months of the year, provided the laborers were employed by the farm or orchard operator. The deletion came in response to a last minute lobbying effort from Meredith and Henry Gorfein, next-door neighbors to a migrant labor camp who have been embroiled in a controversy over its expansion and the permit conditions attached to its operation.
In addition, Piedmont District representative Charles Estes convinced his fellow supervisors to allow farm labor camps by special use permit only on land zoned agricultural or conservation and to limit the housing use to nine months duration. Initially, the proposed ordinance would have given the Board of Zoning Appeals authority to issue a permit for migrant housing in any zoning district; in addition, use of the housing would have been restricted to farm workers but not to a specific time limit.
