Mr. Morehouse pointed out that the federal Environmental Protection Agency has drafted, and Congress has passed, stringent new regulations which ap- ply ta “Schetbde, X)” ..sanitary landfills, which will become effective March 1, 1988. “No landfills will be exempted, and there is no grandfather clause.” Every landfill being operated as of that date must either come into compliance with the new regulations or shut down, the mayor said.

“The Schedule D regulations were amended in 1983 and ’84,” he said, “because no one realized the extent of the pollution from those landfills. A main concern of the new regulations is groundwater contamination.

“We have a potential multimillion dollar situation here. If the landfill is approved under the present regulations, then the new regulations take effect - it will be extremely expensive to bring it into compliance. ”

“Here we have a timing problem,” he continued. “The landfill will be needed before the new regulations are sent to the states ... A private group has applied - here is the application. It is disheartening to say that the state, in its infinite wisdom, before the first public hearing - the state had given preliminary approval to the Lee site.”
