plained. “The old ordinance just said that a use shouldn’t adversely affect the neighboring landowners. Now the new ordinance sets out exactly what must be done to achieve that mandate. Close to half the new ordinance is devoted to those standards.”
The standards “were the sort of thing that the Planning Commission, the Board of Zoning Appeals and the supervisors wrestled with in public hearings,” Mr. McCarthy continued. They include such specifics as requirements on parking spaces, noise limits, number of employees, distance to a neighboring lot line, air pollution, road access, lot size and buffer zones. “Being fallible human beings, the planning commissioners, the BZA members and the supervisors could overlook some of these concerns. Now they’re listed.”
Plus, he noted, controversy often ajFose in the past over just what conditions had been attached to a special use permit. “Now, with the new ordinance, certain conditions are automatic,” said Mr. McCarthy. But, as with the old ordinance, the BZA and the supervisors can still tack on additional conditions appropriate to a specific use on a specific site, the zoning administrator emphasized.
