Supervisors take over permits
In another major change, land uses are divided into two categories: those allowed by special use permit granted by the Hoard of Zoning Appeals and those allowed by special exception permit granted by the Board of Supervisors.
The BZA's authority to grant permits is restricted to those uses which have a neighborhood impact. The Board of Supervisors grants special exception permits for uses which affect a general area, Rappahannock's Comprehensive Plan or the county as a whole. Both the BZA and the supervisors must hold public hearings, with the special exception permit application also taking a public hearing and recommendation from the Planning Commission.
“A lot of things that used to fall within the purview of the BZA are now under the Board of Supervisors’ jurisdiction," Mr. McCarthy noted. "The dividing line is whether the proposed use has a local or a countywide impact."
To list the uses which call for a special exception permit and which require a special use permit, to enumerate the performance standards for uses in each zoning district and to set out what must be included in a site plan would take as many pages as the new zoning ordinance itself. “I’m pulling out guidelines now for two-page summaries that answer the first questions people usually ask,” reported Mr. McCarthy, noting that he has already completed the guidelines for subdivision of agriculturally zoned land.
“Things are spelled out so much clearer in this ordinance,” the zoning administrator maintained. “But you may have to refer to two or three sections to find all that you need to know," he conceded, adding that he's available to guide landowners through the new regulations.
“So much of this document is specifying what the old ordinance mandated,” Mr. McCarthy said, balancing the ordinance’s 190 pages in his hand. “The old ordinance said things must be done without saying how to do it. This adds the ‘how-to’.”
