To the editor:
In each legislative session it seems I find myself in a situation whereby I am tom between two sides of at least one issue that has valid and powerful arguments on both sides. That issue for this session is the related propositions of (1) conditional zoning, (2) impact fees, and (3) proffers, all of which I refer to as “special arrangements" between local governments and developers.
I have informed my friends who are elected or appointed local government officials that I favor legislation providing for these special arrangements only if there are some reasonable guidelines included to prevent abuses.
Local government officials and their powerful organizational lawyers have adamantly and effectively lobbied to prevent the inclusion of guidelines such as preventing the extraction of funds from a developer to pay for public facility needs existing prior to the proposed development.
