“BACK DOOR” BUYING
Every so often, a bargain-hunting buyer will try to deal directly with the seller AFTER he has been shown the house by a Realtor. Maybe this buyer knows full and well what he is doing or maybe not. However, chances are he doesn't know that the seller has a legal obligation to pay the prescribed commission—regardless of whether or not the agent is present at the time of the negotiations. By choosing this route, the buyer cheats himself of the professional services and expertise of an experienced negotiator.
“Back-door” buying works two ways. A seller who is approached directly by a buyer after being shown a home by a Realtor, should contact the Realtor immediately. Since the commission will have to be paid by the seller, there is no reason for the seller not to avail him or herself of the Realtor's services.
The Realtor's obligation is to provide a buyer who is ready, willing and able to purchase the home. This is true regardless of whether the buyer comes in by the front or the back door.
