In a written opinion dated Oo
tober 21, Virginia Attorney General Gerald Bailies affirmed that a superintendent of school^ qualifies as a chief executive officer of a political subdivision of the Commonwealth. But the superintendent can claim an exemption from disclosure for his working papers only as long as those papers are not dissemanted to the school board, the state’s chief law enforcement officer emphasized. The ruling was sought by Rappahannock’s commonwealth’s attorney Douglas Baumgardner after the Rappahannock News filed a formal complaint alledging that the school board was in violation of Virginia’s Freedom of Information Act. The News had requested copies of two architectural reports and budget analysis on the combination bus maintenance facility-central office and a report on the indexed salary scale currently under consideration. The board denied thd requests. Subsequently, a copy of the salary scale proposal was turned over the to the News but with the proviso that the release was voluntary and not required under the Freedom Information Act.
