When the others saw the gun, said Mr. Hickerson, they all jumped in the car and took off. “As they were pulling off, John Leake raised die gun in the air and fired,” said Mr. Hickerson, adding that there were a lot of people running around and screaming. Mr. Hickerson said the defendant rode on the windowsill of his car as they were heading down the mountain toward U.S. 522 and fired twice at the Kennedy car. The defendant said, “I think I hit someone. I heard someone scream,” said Mr. Hickerson. The bullet pierced the trunk of the Kennedy car and blew out the window. Mr. Hickerson said that he and Mr. Leake drove to Linden where the defendant hid the gun in some bushes. They then returned to the firehall in Chester Gap, went back for the gun,' wiped it off, and Mr. Hickerson admitted throwing it into a pond in Fauquier County. That rifle was later recovered by State Police divers and was admitted as evidence at the trial. Evidence showed that a casing found in the parking lot at the Chester Gap Firehall came from the defendant’s rifle. Mr. Luke argued that Mr. Leake had used the rifle in a deadly manner
