NANCY DUNCAN, address unknown, if she be living, or

NANCY DUNCAN, address unknown, if she be living, or if she be dead, her widower, children, heirs, devisees and successors in title, if any such there be, as hereinafter described;

JAMES DUNCAN, address unknown, if he be living, or if he be dead, his widow, children, heirs, devisees and successors in title, if any such there be. as hereinafter described;

AMY DUNCAN, address unknown, if she be living, or if she be dead, her widower, children, heirs, devisees and successors in title, if any such there be, as hereinafter described;

AND ANY UNKNOWN HEIRS, of NANCY DUNCAN, JAMES DUNCAN OR AMY DUNCAN, or her widower, children, heirs, devisees and successors in title, whose names and addresses are unknown and. who are made parties defendant by the general description of “PARTIES UNKNOWN,” and any other unknown heirs, devisees and successors in title, if any such thee be, and/or any unknown parties having an interest in the lands of which NANCY DUNCAN died seized and possessed, whose names and addresses are unknown and who are made parties defendant by the general description of "PARTIES UNKNOWN”

ORDER OF PUBLICATION

The object of this suit is to quiet title and/or establish title by adverse possession as to a tract of land of which Nancy Duncan died seized and possessed, located in Jackson Magisterial District, Rappahannock County. Virginia, said land being described by deed recorded in Deed Book S, at page 140, amongst the- land records of the Clerk's Office of the Circuit Court of Rappahannock County, Virginia, as follows:

All that certain tract or parcel of land situate,

lying and being in Stonewall Magisterial District

of Rappahannock County, Virginia and more

particularly described according to a metes and

bounds survey description set forth in Deed

Book S, Page 140 as follows, to wit:

Beginning at a stone to be planted on the south

side of the road comer to Burley Peyton and

running thence along the road following the old

road N 76 V2 E 13 poles S 67 E 16.30 poles . N 87 Vi E 17.50 poles N 64 Vi E 8 poles N 44 Vi S E 15.30 poles to a stone to be planted in the

middle of the old road and corner to Martha

Duncan’s lot; thence with line of her lot S 36 V4

E 90 poles to a chestnut in P Woodward's line

thence with his line S 48 V4 W 77 poles to a , stone to be planted and corner to Burley

Peyton's thence with his line N 28 W 126 poles

beginning containing “44 acres" and being the

same property conveyed to Nancy Duncan and

her children by deed from William N. Smith and

Allie D. Smith, his wife dated August 27, 1890

and recorded September 4, 1890 in Deed Book

S, Page 140 in the Clerk's Office of the Circuit

Court of Rappahannock County, Virginia.

An Affidavit having been made and filed and the Bill To Quiet Title to Real Estate having stated that the address of Nancy Duncan, James Duncan and Amy Duncan, if they be living, is unknown, and that there are or may be persons interested in the subject matter of this suit whose names and/or addresses are unknown, which Bill has made said parties defendant by the general description, PARTIES UNKNOWN, it is therefore

ADJUDGED, ORDERED and DECREED that all possible PARTIES UNKNOWN having an interest in all of that certain tract or parcel of land which Nancy Duncan died seized and possessed are made parties defendant and said persons are made parties defendant by a general description of "UNKNOWN PARTIES” as the unknown heirs of Nancy Duncan; and

It is further ADJUDGED, ORDERED and DECREED that Nancy Duncan, James Duncan and Amy Duncan if they be living, and any of said unknown heirs, devisees, or successors in title, if any such there be, and/or any unknown parties having ah interest in the lands of which Nancy Duncan djed seized and possessed, whose names an addresses are unknown and who are made parties defendant by the general description of PARTIES UNKNOWN, do appear on or before March 2, 2000, and do what is necessary to protect their interest.

It is further ORDERED that the foregoing portion of this order be published once a week for four (4) Successive weeks in the Rappahannock News, a newspaper having general circulation in the County of Rappahannock, Virginia, within ten (10) days after the entry of this Order of Publication, that the Clerk post an attested copy of this Order at the front door of the Court House and that the Clerk [further prepare a certificate of said facts and file [same in the papers of this cause.
