Last week, in a courtroom in Rappahannock Circuit Court, Mr. Claffy in a plea agreement, pleaded guilty to involuntary manslaughter and driving under the influence of alcohol. Authorities said he had been drinking bourbon during the day of the accident and his alcohol level was .201. The legal limit in Virginia is .08, which means Mr. Claffys level was more than twice the legal limit, according to law enforcement authorities.
At the end of Mr. Claffys plea hearing last week, his attorney Mr. Phillips asked presiding Circuit Court Judge Jeffrey Parker, if Mr. Claffy could make a short statement. The judge agreed to let him speak now, although he said it could wait until sentencing on Nov. 21.
“Yes, your honor,” said Mr. Claffy. “I assume complete responsibility. It was my fault. And sometimes, a lot of the times, I wish it had been me instead of that young boy. Other than that, I have nothing to say.”
Tb those in the courtroom that morning, Mr. Claffys remarks seemed very sincere. Some members of the Foster family, who were there, wished he had voiced them to their family before this.
