Mr. daffy was originally charged with aggravated involuntary manslaughter which carries up to 20 years. With the plea agreement, Mr. Luke reduced the maximum Mr. Claffy could get to 11 years. He said Mr. Claffy had no prior criminal record.
When looking at the state sentencing guidelines in cases where defendants are found guilty of the same offenses of which Mr. Claffy has been found guilty; the average time a defendant serves is one year and seven months, said Mr. Luke, when a defendant has no prior record.
“The sentencing is now in the hands of the judge,” said Mr. Luke.
“It goes without saying this is a tragedy,” Mr. Luke said. “A young man is killed. He was not drinking at all, and was on the right side of the road.
