Approval of Dodson's application would constitute “spot zoning” as defined by Virginia’s Supreme Court in that it would benefit one or more landowners as opposed to complying with the county’s overall land use plan, according to Kenyon. He noted that Rappahannock’s recently adopted comprehensive plan doesn't call for commercial zoning anywhere except in and around existing villages.
In response to a question from supervisor Dick Latham, Kenyon said there are no existing commercial businesses in the Slate Mills area. The little community had a general store that closed some time ago, he said, adding that the store is not shown as commercial on the zoning map. The closest property zoned commercial is the H & J Grocery on Route 231 five or six miles away, said Kenyon.
