Amend Ordinance

“My suggestion is that we not rezone commercial but instead recommend to the supervisors that they amend the ordinance section on uses allowed in an agricultural zone to include automotive garages,” said Luke. "That way, we would not be in violation. Mr. Settle wouldn't be in violation and he could continue his operation."

Noting that the planners are currently involved in a review of the zoning and subdivision ordinances, Luke said this process will not be completed for at least eight to nine months. “But this could be done in 60 days," he said of the amendment to allow garages in an agricultural zone.

"Or we could just not do anything and let Mr. Settle continue," Luke said. “But he would be in violation of the ordinance,” he noted.

The supervisor chairman described his proposal to amend the zoning ordinance as "the only practical solution...Rezoning to commercial in this case is strictly spot zoning," he emphasized.

Adjoining landowner Chris Parrish asked if the suggested amendment to the ordinance would permit Settle to operate an inspection station.

"Since it would be a valid use in an agricultural zone (if the amendment is adopted), I'd say yes," Luke replied. He acknowledged that state
