Commonwealth's attorney Douglas Baumgardner explained that existing enabling legislation allows the supervisors to prohibit carrying loaded rifles or shotguns in a motor vehicle on a public right-of-way but not to pass a cased gun law.
As to enforcement of a prohibition against carrying loaded rifles or shotguns in a motor vehicle. Cross said that the Game Commission has received no complaints about enforcement difficulties from localities that have enacted that type of legislation He also noted that the General Assembly in the last session granted game wardens full police powers, effective Julv 1. 1982.
Imposition On Hunters
Charles Foster maintained that efforts to adopt a cased gun law "will divide the hunters from the people." He said that many hunters don’t own cases and would therefore have to bear the expense of buying them.
Citing problems with groundhog control on area farms, he said it will be an imposition on hunters to case their guns every time they leave a piece of property to go to another field.
As to the necessity of buying cases. Cross explained that cased gun legislation specifies that a weapon must be either cased or dismantled.
‘‘Making a hunter dismantle his gun is even worse than making him case it," Foster countered.
“That’s a real small thing to give up to control these road hunters,” supervisor Wood reolied. (Continued on Page 8)
