court the day after the shooting. At a previously scheduled hearing in Warrenton last Wednesday, Judge Robinson issued a temporary in junction. enjoining Saltonstall from any road construction on the disputed right-of-way.

According to the Kidwells' attorney, a second hearing on extending the injunction was set for this Wednesday, November 17. But both parties reportedly reached an agreement Tuesday afternoon which (1) continues the restraint against further road construction or obstruction of the Kidwells' access to their land and (2) requires that a gate recently erected by Saltonstall across the rightof-way be kept open. In addition, the agreement specifies that there will be no interference with lawful use of the existing roadway and that neither party will harass, disturb or go on the property of the other except to make lawful use of the road.

The agreement, scheduled to be filed in Warrenton on Wednesday morning, is to remain in force until further order of the court. At present. no additional hearings on the right-of-way dispute have been set.
