Rappahannock Circuit Court Judge Thomas D. Home ordered reporters, witnesses, and spectators from the court room Friday as pre-trial motions in the second degree murder trial of Diane Kidwell were heard behind closed doors.
Her trial was scheduled subsequently for March 23.
The closed hearing was sought by defense attorneys. When asked for his position, the prosecutor said he had “no objections” to opening the hearing to the press and the public and “no objections” to the closure.
Charges against Kidwell stem from the Nov. 9 shooting death of Ranee Spellman, manager of Patricia Saltonstall’s Points-Of-View Farm near Flint Hill. Spellman was shot in the chest while operating a bulldozer on a disputed right-of-way that serves the Kidwell property and three lots owned by Ms. Saltonstall.
Kidwell was not charged until after an investigation by a special grand jury empaneled at the request of Commonwealth’s Attorney Douglas K. Baumgardner. Following the special grand jury’s report (a report that remains sealed), Baumgardner reconvened the regular grand jury which rendered a second degree murder indictment against Kidwell Dec. 10.
