Baumgardner asked that the two year sentence with one year suspended be made consecutive with the earlier sentence for arson of personal property, giving Martin a combined time of four years with three to serve. “It’s clear under parole eligibility guidelines that he would be eligible for release now (considering the 435 days already spent in jail),” Baumgardner said. “But I still urge the court emphatically to run the sentences consecutively. . .My judgement is that it is in the public interest to have a year of suspended time hanging over his head. Given his past record, it would be in Mr. Martin’s interest as well,” he maintained.
