The Child Care and Learning Center may finally be able to build the new building it needs.
Rappahanoock’s supervisors and planning commissioners voted unanimously August 23 to amend from 150 to 75 feet the rear setback requirement in an agricultural zone of the 1973 Zoning Ordinance.
“We’re just thrilled the governing bodies of the county were able to see that the 150-foot setback was too restrictive,” said Camille Harris, the Center’s executive director. “This will enable us to build in a much more desirable location.”
The center has argued for months over setback requirements for the new facility, which is planned for a site on Route 211. The Board of Zoning Appeals (BZA) rejected the center’s request for a variance from the previous 150-foot setback requirement by a 3-1 vote July 25.
The BZA rejected the center’s argument tht the site posed a hardship because of poor drainage, a steep upgrade combining with a gully, a right of way and an oddly shaped lot. Center representatives said only 10 percent of the land planned for the new building would be usable without a variance.
