Konick asked that the appeal be dismissed because he said that the evidence introduced by Reynolds was insufficient as a matter of law. Konick said that the letter of appeal was not written correctly because the letter did not state the reasons for the appeal. Reynolds said that the letter conformed to the guidelines in the Rappahannock Zoning Ordinance.
Board member Gregory Monihan said that if Konick’s argument was accepted that the appeal process would be made too complex for the average citizen who did not wish to hire a lawyer, and that the BZA was intended to be as accessible as possible to citizens.
