With the possibility of legal challenge from both sides, the Rappahannock supervisors took “under advisement” a request for a subdivision ordinance exception from Oscar and Stella Lozano. The announcement came after a long executive session at Monday’s board meeting to discuss potential litigation with Commonwealth’s Attorney Peter Luke and zoning administrator John McCarthy.
Under prodding from David Konick, the attorney representing landowners opposed to the exception request, Supervisor Chairman Hubert Gilkey agreed to alert all parties before action is taken. “As soon as we feel we can resolve the situation, we’ll let you know in plenty of time,” Mr. Gilkey promised.
