At issue is a 25.75-acre parcel sold by Lindgren Land Inc. to the Lozanos in July 1978, as two 12-plus acre lots, an apparently illegal subdivision since the land from which the parcel was cut had been previously divided. The adjoining landowners, Mr. and Mrs. Ivan Hall, petitioned the board to vacate the original plat approved by then zoning administrator Evan McNear. (The petition came after Judge Shore Robertson ruled that the Halls had not exhausted all administrative remedies before seeking to have the allegedly illegal subdivision overturned by the Circuit Court.)
