On Feb. 16, Senate Bill 402 was passed and sent to the House of Delegates. This bill requires that the loads of all trucks shall be either secured to the vehicle or covered.
The greatest impact of this bill would probably be felt by dump truck operators. I attempted to amend the bill to provide that a truck would not have to be covered so long as its load extends no higher than six inches below the top of the sides and tailgate of the vehicle. Since my amendment failed to be adopted, I voted against the bill.
If present laws were obeyed, there should be a greatly reduced litter problem and very few incidents resulting in damage to other vehicles. The great majority of loads hauled by dump trucks will not blow out of the vehicle if it is properly loaded.
Present law provides that “no vehicle shall be operated or moved on any highway unless such vehicle is so constructed, maintained, and loaded as to prevent its contents from dropping, sifting, leaking or otherwise escaping.” Other provisions include “. . .no vehicle shall be operated unless its load is securely
