However, when the well-permitting authority becomes vested and once the regional office assures Mr. Shepherd that no legal liability will be incurred, then if the minimum separation distance is met, “we’re going to issue well permits out there [in Rappahannock Lakes],” he said.
As to the septic permit applications now on hold and others which may be sought for the approximately 30 unimproved lots in the old subdivision, “I believe we’re going to have to say no to some,” the district sanitation manager continued. Even without well-permitting authority, if septic approval is sought and the lot does not have an existing water supply, the Health Department is obliged to require a well be sited, and then the minimum separation distance between well and septic fields must be satisfied, he explained. “It will probably be first come, first serve. . .If we apply that minimum separation distance [between new septic fields and existing wells], in all likelihood, it’s not going to be met on those small lots.”
Whatever the outcome, Mr. Shepherd concluded, “we’re not going to make any friends!”
