Chester Gap Rappahannock County In execution of a deed of trust from Combs & Duke Builders Inc., a Virginia Corporation, dated February 20, 1990 and recorded in Deed Book 178 at Page 679 in the Clerk's Office of the Circuit Court of Rappahannock County, Virginia, default having been made in the terms of the loan secured thereby, and having been requested to do so by the holder of the note evidencing said indebtedness, the undersigned trustee will offer for sale at public auction at the front door of the Rappahannock County Circuit Courthouse. Gay Street, Washington, Virginia, on Monday, March 23, 1992, at 12:30 p.m., the following real estate with improvements thereon. Tax Map Identification No. IB2-5 as follows:
All that certain lot or parcel of land lying and being situate in Wakefield Magisterial District, Rappahannock County, Virginia, designated lot 5 containing 1 5256 acre,more or less, of the J. New bill Miller Division, as shown on plat of survey by James G. Buber, Jr. & Associates, P.C., dated December 31,1988, recertified August 25, .1989, and recorded in Deed Book 172, page 742, in the Clerk's Office of the Cuguit Court of Rappahannock County, Virginia.
Together with the rights of others in and to the use of that certain perpetual, non-exclusive twenty-five (25 ) foot right of way for ingress and egress to Virginia Route 610 as shown aforesaid plat.
And being a portion of the same property conveyed to Combs & Duke Builders, Inc., a Virginia Corporation, by deed from J. Newbili Miller and Carol B. Miller, husband and wife, each in his or her own right and as consorts of other, dated and recorded August 31, 1989 in Deed Book 176 at page 249 in the aforesaid Clerk's Office.
This conveyance wilt be made subject to conditions, restrictions, rights-of-way, easements, reservations, and financing statements contained in tne deeds and other land records forming the chain of title to this properly, subject to any potential filed or unfiled mechanic's liens and any other matters of record taking priority over the Deed of Trust being executed, and subject to real estate taxes for the year of 1992. In particular, although there could be others, the Trustee is aware of a mechanic's lien in favor of Wilson Brothers, Inc., in the amount of $7,091.93 plus interest from June 28,1991 (Deed Book 187, Page 3, Chancery #92CH-4) and specifically sells this property subject to this lien, without making any determination as to its validity.
To the extent permissable by law, all bidders, including the successful bidder, waive and release the Trustee, the Noteholder, and their respective agents, successors and assigns from any kind and all claims such bidder or his successors and assigns may have now or in the future relating to the environmental condition of the Property, including any claims pursuant to the Comprehensive Environmental Response Compensation and Liability Act of 1960, as amended, and al other actions pursuant to state or local laws, ordinances, or regulations for any environmental condition of the Property.
