The plaintiffs are attempting to show that the land application of sewage is so safe and so heavily regulated that there is no reasonable basis for the supervisors to ban the practice, and thus the ban is illegal.

The county’s position is that the pollutant limits for sludge set by state and federal regulations may not be adequate to protect the public and that these limits are being actively debated within the scientific community. The Supervisors would rather be safe than sorry and have elected to ban the spread of sludge within the county rather than risk the contamination of soils and waterway s.
