No building permit had been obtained prior to the council hearing.

What had taken place though was the start of construction of Goodine’s proposed building, something which greatly angered many in attendance.
Butch Zindel said, “I’m the naughty builder,” the one who had jumped the gun on construction. He said that it is standard procedure to begin excavation as soon as one files for a permit. McCarthy later confirmed “it is perfectly legal” to do that because the first inspection is the “footers” where the foundation is laid.
