The 1977 session of the General Assembly enacted the Agricultural (and Forestall Districts Act. Its purpose is to provide a means for protecting and improving agricultural (and (forestall land as an important part of the economy and as a major economic and environmental resource.
Districts start with local initiative. Landowners can requcM the formation of an agricultural district. A minimum of 500 acres is required. No single land owner can have more than 3500 acres in agricultural districts. A number of landowners, each having less than 500 acres, can join together to form a district. The parcels of land forming the district are not required to be contiguous.
County governments must certify a proposed district. A public hearing is held by the county to determine citizen sentiment. Recommendations from the county planning commission and the county agricultural district advisory committee and approval by the county Board of Supervisors are required. The Board of Supervisors must act on a request within 180 days after submission.
