Goode redesigned part of the subdivision, combining two five-acre lots into a ten-acre lot that contains over seven acres under 14 per cent slope. The remainder of the subdivision consists of one sevenacre lot with over five acres under 14 per cent slope and 11 five-acre lots with traces ranging from .75 to .05 acres over 14 per cent slope.

Noting that Goode had decreased the number of lots in the developinentJfom the
original 15 to 13^ with the amended proposal, supervisor chairman E. P. Luke maintained that Goode’s subdivision was in “substantial compliance” with ordinance requirements.
