Olson also pointed out that the development plan required by Article 13 of the zoning ordinance was never submitted to and approved by the planners—a prerequisite for issuance of a building permit.

In the letter, the League asked the supervisors to rescind the old building permit, request the Ski Corporation to apply to the BZA for a special use permit under present zoning ordinance requirements, request the Ski Corporation to submit a development plan if the special use permit is granted and finally, direct that a new building permit be issued only if these and all other requirements of county ordinances have been satisfied.

At their March meeting, the supervisors made no formal response to Olson's letter. Chairman E. P. Luke, however, assured League president Bob Dennis that the ski corporation had satisfied all ordinance requirements. Later, at the April supervisor meeting. Col. Luke told Dennis that the Board would reply in writing to the League’s letter. (A check of planning commission minutes shows no approval of a site development plan by that body. A sketch showing the approximate location of the Alpine slide, swimming pool, tennis courts and support facilities was submitted to the planners last year, primarily for informational purposes. The commission took no action on this preliminary plan.)
