Luke stated that he and Baumgardner both agreed the commonwealth attorney should keep a “lower profile,” adding that the commonwealth attorney did not have a vote on the board of supervisors. Should the supervisors want a sheathed gun ordinance, Luke said he would draft the law and prosecute violations.
In response to a question on litter law enforcement and the county’s trash problems, Luke noted that he had been one of the only Virginia Beach police officers to consistently make arrests for littering. When they see a litter violation, individuals have a tendency to cry “Where are the police?” Where are the police?” Luke continued. Law officers “can’t be everywhere...It’s the duty of a good citizen, if you see a crime committed, you have the right to swear out a warrant. If I’m commonwealth attorney, I’ll go as far with that case as I can. I’ll back you up (with prosecution of litter violations)” he pledged.
