Luke noted that he was also the only candidate with actual experience as a prosecutor in criminal cases. “Prosecution is different from any othe area of the law (because) the burden of proof is always on the commonwealth...The defense has no burden of proof. Defense primarily consists of attacking the prosecution’s case, of picking holes in it.”
As commonwealth attorney, a prosecutor must “start with the facts and build a solid case on top of it,” Luke continued. Equally as important, he said the commonwealth attorney must be able to “effectively and convincingly present a case to the judge and jury.”
Luke concluded by promising to apply the law “equally and evenly to every person in the county” if elected.
Commonwealth attorney candidate Douglas Baumgardner promised to work for a more efficient and effective criminal justice system in the county. To do this, he said he would eliminate the current contested day, one day in every month on which all contested cases are tried. In its place, Baumgardner said he would like to see cases tried on a weekly basis. “That way, I could devote more time to
