There's a lesson to be learned by local government from the Windmill case that contradicts the advice given just a few months ago to the county planning commissioners as they worked on Rappahannock's first comprehensive plan, Baumgardner continued. “In respect to a comprehensive plan and zoning law, local government must be very careful to be specific and to set standards," he said, acknowledging that he’d told Rappahannock’s planning commissioners to keep the county's plan as general and unspecific as possible. That was good advice under Virginia law as it was interpreted by the courts a few months ago but the Windmill decision has changed that philosophy, Baumgardner concluded.
