‘‘I talked to the man over there and he told me I had to build the garage before I could get it rezoned," said Dodson, identifying the source of this advice as* zoning administrator Evan McNear.

“And he told you to put the building up and then ask for a rezoning?" inquired chairman Herbert Barksdale.

‘‘Yes sir,” Dodson answered.

Violates Intent

Leading off opponents, Irvin Kenyon maintained that Dodson's rezoning proposal “doesn’t fit in any way, shape or form" with the intent of the county's zoning laws. Kenyon is a neighboring landowner with property only 150 feet away from Dodson’s parcel.

According to its statement of purpose, Rappahannock's zoning ordinance is designed “to conserve properties and their values." Kenyon pointed out. "If this rezoning is approved, property values will decline," he said. Kenyon said he’d asked two county realtors for the effect of next-door commercial zoning on the value of his property. “They said there wasn’t any way it would go but down.”
