In Circuit Court on Tuesday, Judge Shore Robertson dismissed charges against Admiral Josef Gardiner, chairman of the Rappahannock Board of Zoning Appeals, for failure to file real estate disclosure forms by the December 31 deadline.
The dismissal came at the recommendation of commonwealth attorney Douglas Baumgardner who maintained that charges were improperly presented. According to Baumgardner, the Virginia Code gives sole power to enforce the disclosure requirement to the state Attorney General and local commonwealth attorneys. The complaint against Gardiner was lodged by Washington attorney David Konick.
