At the same time the Atkins' variance request was approved, the BZA tabled a variance application from Mary and Frank Neal of Castleton to subdivide a 37acre parcel zoned residential subdivision into one sevenacre lot and one 30-acre lot, pending a legal opinion from the commonwealth's attorney.

“That’s not a problem for the board of zoning appeals. That’s a problem for the board ot supervisors,” maintained GardineT on Wednesday, suggesting the Neals’ variance request be passed on to that body.

Baumgardner said he’s reviewed their application and believed that the request could be treated as a boundary adjustment if it was remanded to the zoning administrator. He added that he will give the BZA a written opinion on the matter.
