Last month, when he presented the planning commission with the rough draft of the first few chapters of a revised zoning or* dinance, professional planner Dick McNear proposed dropping the blanket prohibition against resubdivision of land zoned RS-1, on the grounds that total prohibition was legally indefensible. He suggested instead that resubdivision be allowed by special exception permit issued by the board of supervisors but only in accord with strict, specific standards.
Weakens Ordinance?
“I’m really concerned about this thing," said Miller at the planning commission’s December 16 session. “I’m afraid we’re getting ready to weaken our existing ordinance...We’re inviting a suit rather than presenting a show of strength.”
