In circuit cpurt last Thursday. Judge Shore Robertson quashed the subpoena sought for commonwealth’s attorney Douglas Baumgardner by Ernest Lee Douglas.

Douglas is charged with the malicious wounding of Peter Marks in an incident that occurred near Washington on November 18. 1979. The majority of the delays in bringing the case to trial relate to examinations of the defendant to determine his competency to stand trial. Baumgardner told the court on Thursday.

Douglas maintained, however, that the delays were all instigated by the commonwealth’s attorney. He said that in addition to asking Baumgardner for the reasons behind the numerous delays, he wanted to question him about the deposition given by Peter Marks, the man Douglas is accused of shooting.
