The other case in question involved Hamilton Brown Scott, represented by Sharon Luke. Scott pled guilty to driving under the influence and offered to enroll in an out-patient alcohol treatment program at Primavera since he had previously attended VASAP in 1979. Luke suggested Primavera to the judge because “we didn’t think you'd let him in (VASAP) again.”
Because Scott’s record was fairly good otherwise, Alexander said he would reassign him to VASAP because “the program has considerably broadened since 1979” and in place of Primavera because “the court wouldn’t know a good alcoholic treatment program from a bad one; it is not within my area of expertise.”
However. Alexander noted that he was “breaking one of the general policies of this court. One slip and you’re out!" Offenders are not usually assigned to VASAP twice.
Scott was also fined $200 plus costs and had his license suspended . for six months except for while driving to, from and during his job as a heavy equipment operator and to and from VASAP meetings.
