The town is presently operating under an 1894 charter which lacks clear town boundaries and confers insufficient powers on the town council, according to Baumgardner. He added that he has already started work on the new charter using a sample form provided by State Senator Kevin Miller.
Meanwhile, the new zoning ordinance must set forth the exact town boundaries and the various districts within, according to Baumgardner. It must also provide for appointment of a town Board of Zoning Appeals.
One of Dickey’s contentions was that the Town Council lacks stature as a Board of Zoning Appeals, one of the questions the council expects the joint Planning Commission to address in its amendments to the 1971 ordinance code.
