The bed and breakfast projects had been delayed due to concerns that they might impact the residential character of the neighborhoods and lead to other commercial ventures. The Town Council had postponed its decision until hearing from town attorney Douglas Baumgardner. In a letter dated April 24, Baumgardner said that the courts have held that “the issuance of a special exception permit, standing alone, does not create a legally binding precedent.” Baumgardner further suggested that Town Council could specify that any increase in the intensity of use of the properties would require an additional special use permit.
