The council must also hold a public hearing to consider the amendment. A joint public hearing with the Planning Commission is permissible to speed up the process, “but there’s no way you can do it in less than a month and it would probably take two months to do it right,” the attorney said. He pointed out legal requirements for two weeks of public advertisement of the council’s intentions. “You have to listen to the public, too, and they may not want this to happen.”
The council approved a resolution requesting the Planning Commission to consider an amendment to the comprehensive plan to accommodate the rezoning proposal, and asking for a recommendation on the plan to rezone Lots 16, 16A, 17 and ' ’ 17A from village residential to village mixed-use. The council requested a reply within 30 days and set a joint public hearing for the meeting Feb. 10. Mr. Morehouse told Mr. Giles that date was the earliest which he could get an answer, “and the latest is the March meeting, if the Planning Commission doesn’t make a recommendation at the joint public hearing.”
