Federal pensioners await ruling
County residents affected by the recent Supreme Court decision, Davis v. Michigan, which held that taxation of federal retirement benefits, but not state and local pensions, was unconstitutional, are not entitled to retroactive relief, according to the Virginia Tax Commissioner. However, county Commissioner of Revenue Beverly Atkins added, two appeals of this ruling have been filed in Northern Virginia courts, and a final ruling rests on the outcome of these cases. Ms. Atkins said all pensioners will be granted one year from the date of that ruling to file any necessary paperwork for tax years 1985, '86, '87 and '88. No amended returns will be accepted by the Department of Taxation until those pending cases are resolved. The General Assembly passed legislation addressing future tax years, but Gov. Gerald L.
