This is the same and identical tract or parcel of land acquired by the said Thomas R. Starks, from Theo. Smith and Elizabeth A. Smith, his wife, by deed dated January 21, 1920, and recorded February 18, 1920, in the Clerk’s Office of the Circuit Court of Rappahannock County, Virginia, in Deed book 29, at Page 481. LESS AND EXCEPT the following conveyances therefrom theretofore made by the Grantor under said deed of trust: (A) A conveyance to Hattie May Ward, by deed dated August 5, 1961, and recorded August 7,1961 in the aforesaid Clerk’s Office in Deed Book 75, at page (B) A conveyance to James Starks and Mary Starks, husband and wife, by deed dated February 15, 1965, and recorded March 11, 1965 in the aforesaid Clerk's Office in Deed Book 83, at page 69. TRACT #2: All of that certain tract or parcel of land lying and being situate in Hampton Magisteria I District, Rappahannock County, Virginia, containing 311/4 acres, more or less, and being that same land conveyed to Thomas Starks, by deed of Henry Timbers, et ux, dated March 15, 1946 and recorded in Deed Book 46 at Page 358 of the Clerk's Office of the Circuit Court of Rappahannock County, Virginia.
Reference is hereby made to the aforesaid deeds and to the references therein contained for a more complete and accurate description of the tract or parcel of land thereby conveyed. Information as to the status of record title and the improvements on the above described real property and all documents available to the Trustee may be examined by prospective purchasers at the office of the Trustee on Monday through Friday, inclusive, on each day (exclusive of legal holidays) betwen 2:00 PM and 4:00 PM. Inquiries may be made by telephone and requested information will be provided by mail. A deposit of ten per cent of the succesful bid (cash or certified or cashier's check) will be required of the successful bidder at the time of sale with the bal- , ance due at settlement, which shall be held on or before thirty (30) days from the date of sale. Time shall be of the essence with respect to settlement. The deposit shall be applied to the credit of the successful bidder at settlement: or in the event of a failure to complete settlement, within thirty (30) days after the date of the sale, in accordance with the terms of sale, the deposit shall be forfeited and applied to the costs of sale, and the property shall be resold at the cost and expense of the defaulting purchaser. The balance of the purchase price shall be in cash or its equivalent at the time of settlement. The subject property and the improvements1 thereon shall be sold in "as is" condition without warranties of any kind. Real estate taxes shall be adjusted as of the date of sale. The conveyance shall be by Special Warranty and the Grantor's tax and cost of preparing the deed shall be the expense of Seller. Examination of title, other recording charges, notary fees, and settlement fees will be at the cost of the purchaser. The Trustee reserves the right (i) to extend the period of time within which the purchaser is to make full settlement; (ii) to withdraw the property from sale at any time prior to the termination of the bidder; (iii) to keep the bidding open for any length of time; and, (iv) to postpone or set over the date of sale. In the event the Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, such notices of postponement or setting over will be in a manner deemed reasonable by the Trustee.
