Sheriff Woodward and his deputies, Mr. Luke said, cannot enforce town ordinances. “County and state ordinances can be enforced within the town limits, but it doesn’t work backwards.” If there were a county loitering ordinance the sheriff could enforce it, but not one passed by the town.
There are ordinances which prohibit the type of conduct which has drawn complaints, Mr. Luke said, including trespassing, disorderly conduct, curse and abuse, drunk in public, drunk and disorderly conduct. “There is a whole range . . . none of which prohibit just standing around.
Last week, Sheriff Woodward said, Eileen Day, who owns the Clopton House, and representatives from Trinity Church went to the magistrate and had trespass notices taken out against 11 individuals who have been congregating in the parking lot. Most of those notices have been served, the sheriff said.
A trespass notice, Mr. Luke explained, effectively bars a person from property owned by the complaintant. If the individual returns to the property after being served, he is subject to arrest and prosecution for criminal trespass.
Notice does not have to be given in writing, he said, but may be either verbal or by posting “No Trespassing” signs. Personal service by the sheriff, he said, merely eliminates the possibility of misunderstanding.
