Without some checks and balances, preservation laws could get this onerous. At what level of the bureaucracy would you want to deal with to get problems corrected— federal, state, or local?
In reality, historic designations can amount to restrictions that almost amount to “federal zoning laws.” The 10th Amendment provides that all powers not specifically given to the federal government shall remain with the state and local governments. Is federal bureaucracy trying to usurp those rights? Congressman Allen is trying to maintain these rights for all of us.
Some warn of dire consequences for history and the possible demise of sites like Monticello, Mount Vernon, or Williamsburg, but there are two important things to remember: these three sites are privately held and maintained and none of these sites would be effected by this amendment.
