When the time came for a vote Alex Sharp and Jimmy Swindler Jr. voted for the application. Sid Gottlieb, “Butch” Zindel, and Jennifer Matthews said they could not make the finding that “The proposed use shall be such that the pedestrian and vehicular traffic generated will not be hazardous or conflict with the existing and anticipated traffic in the neighborhood and on the streets serving the site,” so the application was denied.
The BZA later approved an application by Leon and Betty Hutchinson to have a three-room bed and breakfast in their home on a 50foot right-of-way off U.S. 522-211 across from the high school. In that case, not only is the right-of-way wider, but there is also a maintenance agreement among the property owners using the road. Also none of the other property owners opposed the application and two wrote letters to the BZA supporting the Hutchinsons.
The BZA also denied an application for horse trailer sales. Carol Quaintance had applied to have up to four trailers for sale on her property near Flint Hill. No one appeared at the BZA to either support or oppose the application. The application was denied because members said it was not a suitable location for a sales business.
