On or before September 30. 1994, person desiring to partici pate as Protestants, as defined in Rule 4:6 of the Commission's Rules of Practice and Procedure ( "Rules”), and to present evidence and cross-examine witnesses shall file an original and fifteen (15) copies of Notice of Protest, as provided in Rule 5:16(a), with the Clerk of the Commission, c/o Document Control Center, P.O. Box 2118. Richmond. Virginia 23216. referring to Case No. PUE940045 and shall on the same day serve a copy of the Notice of Protest upon the Company and all other parties of record. Service upon Potomac Edison shall be directed to: Philip J. Bray, Esquire, The Potomac Edison Company, 10435 Downsville Pike. Hagerstown. Maryland 21740-1766: Alan P. Buchmann. Esquire, Squire. Richmond, Virginia 23219-4074. Any corporate entity or governmental unit that wishes to protest must be represented by legal counsel as required by Rule 4:8.
On or before October 17, 1994. all Protestants shall file with the Clerk of the Commission an original and fifteen (15) copies of a Protest, conforming to Rule 5:16(b). and an original and fifteen (15) copies of the testimony and exhibits they intend to present at the December 7 hearing. Protestants shall serve a copy of the Protest, testimony, and exhibits on PotOmac Edison's counsel and on all other parties. The Protest shall set forth: (i) a precise statement of the interest of the Protestant ip th£ proceeding: (ii) a full and clear statement of the facts which the Protestant is prepared to prove by competent evidence; and (iii) a statement of the specific relief sought and the legal basis therefor.
