Mr. Luke said the Sprint/Centel lawyers wanted the language in the contract in case the law changes. He and Mr. McCarthy agreed it is not likely that law will change.
The contract calls for the county to indemnify the company “to the extent allowed by law,” Mr. Luke said. He added, “In my opinion that is none.”
Mr. McCarthy said, “One other choice is to sue them. That would mean a multi-month delay in implementing E-911.”
“A multi-year delay, more likely,” Mr. Luke said.
Debate continued. Hampton District representative Mike Massie said he could not agree to having the county sign such a contract. Wakefield District representative Hubert Gilkey suggested the county seek help from the Virginia Association of Counties in fighting the provision. Jackson District representative Ellis Bingham suggested getting assistance from a Richmond law firm. Piedmont District representative Charles K. “Pete” Estes asked Mr. Luke to make a recommendation.
